Exemptions, Joint Employment, And Regular Rate: Everything you Need to Know to Keep Up With The DOL’s New Regulations*

Presented by Paul DeCamp, JD, and Greta Ravitsky, JD, Epstein Becker Greens 

Earlier this year, the U.S. Department of Labor proposed revisions to the regulations that (1)  define the salary requirements for the executive, administrative, and professional exemptions under the Fair Labor Standards Act; (2) substantially modify the standards for determining when a joint employment relationship exists under the FLSA; and (3) clarify and modernize the guidance relating to whether certain types of compensation, including several popular forms of benefits that have emerged in recent years, become part of the regular rate calculation when determining overtime pay.  The comment periods for these regulations has closed, and the Department is in the process of evaluating the various comments submitted by the public.  The Department is likely to issue Final Rules for these various regulatory proposals in late 2019 or early 2020, but prudent businesses will want to begin preparing now.  This program will examine the proposed changes to each of these regulations, offer tips for how to prepare an organization for these changes, and provide interactive group exercises to maximize understanding and retention.

*The workshop offers 6 PDCs for the SHRM-CP and SHRM-SCP and 6 hours of HR (General) credit towards PHR and SPHR recertification requirements.

Presenters

PAUL DECAMP is a Member of the Firm in the Employment, Labor & Workforce Management practice, in the Washington, DC, office of Epstein Becker Green. He is Co-Chair of the firm’s national Wage and Hour practice group.  A former Administrator of the U.S. Department of Labor’s (DOL’s) Wage and Hour Division, Mr. DeCamp has more than two decades of experience representing employers and trade associations in the most complex and challenging wage and hour litigations, government investigations, and counseling matters. Mr. DeCamp has served as lead counsel in class and collective actions across the country.  His work spans a broad range of industries, including aerospace, financial services, gaming, health care, hospitality, manufacturing, restaurants, retail, transportation, and many others.

GRETA RAVITSKY is a Member of the Firm in the Employment, Labor & Workforce Management practice, in the Houston office of Epstein Becker Green. Ms. Ravitsky has significant experience representing and counseling employers in a variety of labor and employment matters arising under federal and state law, including Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act, the Americans with Disabilities Act, the Family and Medical Leave Act, the Fair Labor Standards Act, the Employee Retirement Income Security Act (ERISA), and Section 1981.
