Presented by Joanne Bush and Lindsay A. Hedrick, Partners, Jones Day
The U.S. has experienced a sharp increase in the use of prescription and non-prescription opioids over the past ten years. President Trump recently declared the opioid crisis a national public health emergency. Companies are facing new HR-related questions stemming from employees’ increased use of opioids. For example, an employee taking opioids may or may not be doing so according to a doctor’s prescription and an employee’s legal use may or may not impact his or her ability to perform essential job functions. This session will focus on the ways in which opioid use is creating unique challenges for employers in regard to employment laws regarding leaves of absence, disability, and drug testing and what an employer can, cannot, and should do in such situations.
